Welcome to MEGABOT. By accessing or using our APIs and services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use our services.
01. Acceptance of Terms
By creating an account or using MEGABOT APIs (SolanaRouter, PumpIntel, WhaleAPI), you agree to:
- Comply with these Terms and all applicable laws
- Be at least 18 years old or have parental consent
- Provide accurate and complete registration information
- Keep your API keys confidential and secure
02. API Services
2.1 Service Description
MEGABOT provides three API products:
- SolanaRouter: Intelligent RPC routing and failover for Solana blockchain
- PumpIntel: Real-time Pump.fun token analytics and graduation tracking
- WhaleAPI: Whale wallet tracking and smart money intelligence
2.2 API Keys
Your API key is your authentication credential. You must:
- Keep API keys confidential and secure
- Not share, publish, or expose keys in public repositories
- Immediately regenerate keys if compromised
- Be responsible for all activity under your API key
2.3 Rate Limits and Quotas
Each subscription tier has defined rate limits and monthly quotas. Exceeding limits will result in HTTP 429 errors. We may throttle or temporarily suspend service if abuse is detected.
03. Acceptable Use Policy
3.1 Permitted Uses
You may use MEGABOT APIs for:
- Building Solana applications, trading bots, and analytics tools
- Integrating blockchain data into your products
- Research, backtesting, and educational purposes
3.2 Prohibited Uses
You may NOT:
- Resell, redistribute, or white-label our APIs without written permission
- Attempt to reverse engineer, decompile, or hack our infrastructure
- Use our APIs for illegal activities, market manipulation, or fraud
- Scrape or store excessive data beyond reasonable caching
- Bypass rate limits or abuse free tiers with multiple accounts
- Use our services to spam, phish, or distribute malware
- Impersonate MEGABOT or misrepresent your relationship with us
Warning:
Violation of these terms may result in immediate API key revocation, account suspension, and legal action.
04. Billing and Payments
4.1 Subscription Plans
We offer free and paid subscription tiers. See our Pricing page for current plans.
4.2 Payment Terms
- Subscriptions are billed monthly in advance via Stripe
- Prices are in USD and subject to change with 30 days notice
- You authorize automatic recurring charges
- Failed payments may result in service suspension
4.3 Upgrades and Downgrades
- Upgrades take effect immediately with prorated billing
- Downgrades apply at the end of the current billing period
- No refunds for mid-cycle downgrades
4.4 Refund Policy
We offer a 14-day money-back guarantee for first-time subscriptions. After 14 days, no refunds are provided for unused time. Contact support@getmegabot.com for refund requests.
4.5 Cancellation
You may cancel your subscription anytime. Access continues until the end of the billing period. No partial refunds for early cancellation.
05. Service Level Agreement
5.1 Uptime Guarantee
- Free Tier: No uptime guarantee (best effort)
- Paid Tiers: 99.5% monthly uptime target
- Enterprise: 99.9% monthly uptime with custom SLA
5.2 Maintenance and Downtime
We may perform scheduled maintenance with advance notice. Emergency maintenance may occur without notice. Scheduled maintenance is excluded from uptime calculations.
5.3 No Warranty
Services are provided "AS IS" without warranty. We do not guarantee uninterrupted, error-free, or secure operation.
06. Data and Privacy
- We collect and process data as described in our Privacy Policy
- You retain ownership of data submitted via our APIs
- We may use aggregated, anonymized data for analytics and improvements
- API request logs are retained for 90 days for security purposes
07. Intellectual Property
7.1 Our Rights
MEGABOT retains all rights to:
- API infrastructure, algorithms, and proprietary technology
- Trademarks, logos, and branding
- Documentation, guides, and content
7.2 Your Rights
You retain ownership of applications and data you create using our APIs. We grant you a limited, non-exclusive, revocable license to use our APIs per these Terms.
08. Limitation of Liability
Important:
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MEGABOT SHALL NOT BE LIABLE FOR:
- Indirect, incidental, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Trading losses or financial damages from API usage
- Damages exceeding fees paid in the 12 months prior to the claim
09. Indemnification
You agree to indemnify and hold MEGABOT harmless from any claims, damages, or legal fees arising from:
- Your violation of these Terms
- Your use or misuse of our APIs
- Infringement of third-party rights
- Your negligence or willful misconduct
10. Termination
10.1 Termination by You
You may terminate your account at any time by emailing support@getmegabot.com. Cancellation is effective at the end of the billing period.
10.2 Termination by Us
We may suspend or terminate your account immediately if:
- You violate these Terms or our Acceptable Use Policy
- Your payment fails or account is past due
- We detect fraudulent, abusive, or illegal activity
- We discontinue services (with 30 days notice)
10.3 Effect of Termination
Upon termination:
- Your API keys are immediately revoked
- Access to services ceases
- We may delete your data after 30 days
- Outstanding fees remain due
11. Changes to Terms
We may update these Terms periodically. Changes will be posted on this page with an updated "Last updated" date. Material changes will be announced via email. Continued use after changes constitutes acceptance.
12. Dispute Resolution
12.1 Governing Law
These Terms are governed by the laws of the United States and the State of Delaware, without regard to conflict of law provisions.
12.2 Arbitration
Disputes shall be resolved through binding arbitration, not class action lawsuits. You waive the right to jury trial.
13. Miscellaneous
- Entire Agreement: These Terms constitute the entire agreement between you and MEGABOT
- Severability: If any provision is invalid, the rest remains enforceable
- Waiver: Failure to enforce any right does not constitute a waiver
- Assignment: You may not assign these Terms; we may assign without notice
